Fakir Group managing director and brave freedom fighter CIP Fakir Aktaruzzaman filed the case in Dhaka's 5th Joint District Judge Court.

According to the case report, Gulshan entered into an agreement with Disney Properties Limited to purchase two apartments in a high-rise residential building named 'Eva Rose' at Plot 6/B, Block CWN (B), Road No. 44, Gulshan 2. Fakir Masrikuzzaman, Deputy Managing Director of Industrial Fakir Group and Director Fakir Masfikuzzaman signed an agreement to buy two flats on March 28, 2016. These two flats are located on the 6th and 7th floors and each flat has an average area of ​​approximately 4500 sq.ft. The agreement also mentions essential rights of occupancy including two car parking and landscaped land.

Sheikh Urmi Arman (Eva) got this land from her ex-husband Mahfuzur Rahman. He was then known as Eva Rahman. EVA entered into an agreement with the developer company Disney Properties Limited to construct the building on this land and gave the registered power to that company on February 18, 2010. Later, when Eva's dispute started with the developer, Eva herself took responsibility for the construction of the building.

On December 3, 2017, a registered sale agreement (Agreement No. 8536 and 8537) was entered into with Fakir Masfikuzzaman (Fabi) and Fakir Masrikuzzaman for two flats. According to the contract, Eva promised to complete the rest of the building and register the two flats to Fakir Masfikuzzaman and Fakir Masrikuzzaman. According to the agreement, Fakir Aktaruzzaman's two sons paid all the money for the apartment.

It was also mentioned in the contract that Eva will complete the construction work within six months under his own responsibility and register the buyer with Saf Kawla. However, the possession of the two flats was conveyed to the two buyers in an incomplete state without complying with the terms of the contract.

Advocate Zafar Sharif, Fakir Group's legal advisor, said that Eva Arman refused to accept the conditions of the registered sale deed. Rather, he is lying that he did not sell those two flats. Later, Eva filed a civil case (No. 245/2023) in the 1st Joint District Judge's Court regarding those two flats. The court ordered both to maintain status quo and the case is currently ongoing.

Meanwhile, Eva filed a petition case (No. 83/2022) against Fakir Aktaruzzaman in the Executive Magistrate's Court alleging breach of peace and order regarding the two flats. Later the court dismissed the case.
