Appeal verdict on Jamaat's registration tomorrow

The verdict on Jamaat-e-Islami's appeal to regain its registration

political party will be announced tomorrow, Sunday.

The matter has been placed for ruling on item number 1 of Sunday's agenda by a four-judge Appellate Division bench led by Chief Justice Dr. Syed Refat Ahmed.


After hearing the appeal for a total of four days, the Supreme Court set a date for its verdict on May 14.


Barrister Ehsan Abdullah Siddiqui and Advocate Mohammad Shishir Monir appeared in court on behalf of Jamaat, while lawyer Touhidul Islam appeared on behalf of the Election Commission.


The High Court, after settling a writ petition,

issued a verdict on August 1, 2013, cancelling the registration of Jamaat-e-Islami and declaring it illegal. Then, on December 7, 2018, the Election Commission (EC) issued a notification cancelling the registration of Jamaat-e-Islami. At the next stage, Jamaat-e-Islami appealed against the verdict in the High Court.


However, last November, the Appellate Division, led by then Chief Justice Obaidul Hasan, dismissed the appeal by calling it 'dismissal for default', as Jamaat's main lawyer was not present at the appeal hearing against the High Court's verdict.


As a result, the High Court's ruling declaring Bangladesh Jamaat-e-Islami's registration as a political party illegal remains upheld.


At one point, during the anti-discrimination student uprising, Sheikh Hasina's government banned Jamaat-e-Islami and Islami Chhatra Shibir on August 1. The Ministry of Home Affairs issued a notification banning Jamaat, Chhatra Shibir and their other affiliates under Section 18(1) of the Anti-Terrorism Act. However, on August 28, the decision to ban Jamaat-e-Islami and Islami Chhatra Shibir was revoked and a notification was issued.


On the other hand, a petition was fil

edto revive the appeal filed against the High Court's verdict declaring the registration of Bangladesh Jamaat-e-Islami as a political party illegal. After that petition, lawyer Mohammad Shishir Monir said, "The pending case in the Appellate Division has not been fully heard and settled. It was 'dismissed for default'. That is why we are filing a petition to revive the case."

After the restoration

application was approved on October 22 , the appeal hearing began again on the merits. This opened the way for Jamaat's legal battle to regain its registration.
